STATE TROOPER!

 A Collection of Articles

                    By:  Eddy LaBarr

... Eddy LaBarr: ... Civil Rights Advocate, Victim of high tech harassment/surveillance for almost 2 decades,  Survivor of a 72 hour long warrantless - illegal SWAT training operation.  These pages are not intended to promote illegal drug use. This is not a Pro-Drug site. This is a Pro-Common sense and Anti-Prohibition site..

Drug Prohibition causes police not to enjoy the respect they deserve...     Forfeiture of Respect... A totally inappropriate application of law enforcement.

It's almost impossible to drive anywhere without being menaced by one of these State Troopers sitting on the side of the road assigned to target out-of-staters. Travelers are tormented with combat level terse interrogations and left screwed up for life.

I'd thought of installing locomotive horns inside my van for Troopers who search without consent. They'd probably think that was bad, more humane than alternatives a criminal might deploy.

ARIZONA'S "FELONIES" SHOULD NOT CARRY THE SAME WEIGHT AS REAL FELONIES IN OTHER STATES.   The dim AZ State Trooper's aggression described below has helped to expose the worst criminal organization of all -The DEA...

A Colorado Trooper says: "No you do not have to consent & searches are supposed to be consensual."  He also commented on Arizona's reputation for incidents like the one below:

state troopers, a once proud and dignified traffic law enforcement group have exceeded the scope of their duties and have evolved into a menace to travelers and the scourge of freedom. Thanks to prohibition and drug laws, their roles as guardians of public safety have been tarnished by Acts inconsistent with the U.S. Constitution; profiling and ruining lives.

Shown above is the notorious Arizona DPS, a group which is now despised by law abiding citizens from all walks of life. Troopers are excellent drivers and are trained to keep traffic moving, but, they've soiled their reputations and endanger the public by adding the line, "May I have consent to search your vehicle?" to the end of each traffic stop. This act exceeds the scope of their duties and encroaches into areas of unconstitutional infringement.

Accumulating on this page will be a digest of articles, horror stories and victim accounts of profiling, vehicle searches, ruthless search attempts, harassment and menacing of citizens in the name of the Drug War.. Out of state travelers passing through are victimized by these bigots as they are pulled over for little or no reason and a vehicle search attempt is made. The Flagstaff division of DPS,  has gained the reputation of racial profiling and of intense profiling of out-of-staters'. Typical complaints include; blacks being followed for 25 miles on I-40, then pulled over for "following too closely," then -the vehicle doesn't move an inch, for hours if necessary, until the driver consents to allowing a search by the "officer" or a canine unit travels from a distant location and is walked around the vehicle. The trooper is behind the victim's vehicle with his lights on the entire time and the person "does not feel free to leave" -legally constituting a Seizure

Lee Phillips, Attorney at law, in Flagstaff had 40 such cases on his desk, recently when he decided to FOIA the DPS for copies of the past year's traffic tickets to analyze the percentage of citations issued to blacks. DPS quickly destroyed all of the requested evidence.

... Arizona's DPS willfully destroyed evidence ...   ...As Arizona's Black prison population swells the state shall now have to appropriate more funding into it's coffers to accommodate. Arizona just picks off Blacks passing through like a Duck Shoot and incarcerates them for profit, protected solely under the premise that the parties they are selectively profiling cannot afford to correct the problem.  And catching other state's travelers at a legal disadvantage...

I was a victim of such a profile stop north of Flagstaff in April, 2000. (Most likely) because I had out of state plates, I was singled out of three vehicles and was detained for 90 minutes with the engine running while a canine unit drove nearly 40 miles up out of Flagstaff. I refused to consent to allowing a search when asked and the Trooper retorted, "That's suspicious" then radioed for a canine unit. While we were waiting, I was taunted and drilled with multiple questions from different angles and insinuations addressing just what it was I didn't want the police to see. ... And, if I'm a law abiding citizen, as I claim, then why am I not cooperating with law enforcement? Intense questioning.   ... He commented, "Well it looks like your not cooperating."  You can go stand over there by that tree I just want to have look inside your van... (Any search is supposed to be consensual, So when a trooper says "Go over and stand by that tree while I illegally search your vehicle"  -is a 5 second hesitation then a misdemeanor and then a 10 second hesitation an instant Arizona Felony?)

... I was so shocked at the way I was being treated, I almost couldn't articulate words. Nothing was detected by the dog and other than driving 70+ in a 65 zone (with the rest of the local traffic), I was in not in violation of any state or federal laws, but was, none the less singled out of much faster local traffic for the stop and Dog Walk search. Greater injury set in when I didn't go back to Arizona and follow through with civil rights litigation. This, lack of action on my part, gave them the message that citizens are tolerant of Constitutional rape and of the "religious police" mentality of this massively overstaffed, over budgeted law enforcement apparatus. When a state trooper says: "May I have consent to search your vehicle?" He's actually saying, "Our department has a huge budget excess. We are unconcerned about  your Constitution protective safeguards and I have nothing to do with my time and need to be fired."

A 90 MINUTE DISCUSSION ON 6TH GRADE LEVEL CIVICS

May I have consent to search your vehicle? ...Or Umm, May I have consent to trash your life for cold-blooded profit?

Aggressive Drug Warriors Either Search Out-Of-State Travelers Or They Rehearse Their Criminal Interrogation Tactics as a means of psychological injury.  Arizona's DPS profiles victims who appear to be below a certain income or education level. (These ol' boys aren't searching attorney's cars).  Troopers seem to evaluate potential victims in a similar manner to which convicted rapists choose their victims.

An Arizona TV survey of rapists serving time in prison included a film showing women on the campus where the convicts were asked whom they would target. They didn't choose any of the cheerleaders, (because they would most likely get body slammed and their thing ripped off), they chose the one(s) who were struggling with piles of books too big to manage, or preoccupied with issues, had a few problems under the hood..., not paying 100% attention to everything every split second, etc.   The rapist chooses a victim who already has problems and then sends them over the deep end into the abyss with the act of rape. The same scenario happens when Troopers perpetrate profiling. Their subject gets caught with a little weed in their car and their student loan qualifications are lost due to their new status as a Felon in AZ. Then they don't finish their schooling and they're just meat for Arizona's ruthless meat grinding Prison-For-Profit,  soul-less state prison industry.  If some of these Stratospheric High Flying  Drug Warriors  (No Names Mentioned) are elected in 2008 the entire United States will most likely come to reflect this budgetary motif.

Arizona troopers get away with this because no one takes appropriate legal action. If you are pulled over in Arizona and the Klan-type pops the question of "May I Have Consent To Search?"

Answer:   NO

The Klan-type will usually retort, "And why not -(or worse)?"

Answer:    1)- The search is Unconstitutional and unnecessary.

2)- I don't want to.

3)- I don't have to.

I have given you 3 answers and you are required to articulate your probable cause for detaining me further.    Am I free to go?

...At this point the Drug Warrior Troopers come standard equipped with a cacophony orifice which opens and reveals his underlying hate-motive for your culture.  "Cultures can be kept in check by making pinpoint examples." Watch out, the way the Drug Warrior will subject you to the lowest criminal  treatment and employ techniques in the attempted search which will cause Major Depression to occur at about the 12 month point after the attempt. Arizona's laws prohibit suits from being filed after 6 months. You MUST stop the injury before it starts as there is NO protection. In example, this entire web site probably wouldn't be here today had this author not been so injured and set back years in a ruthless vehicle search attempt.

Sue them for any reason possible. You have the Right to film the offender during any traffic stop -do it.   Remember that if a  Drug Warrior Cop asks to search, they had to have passed the Golf Ball and Garden hose Test to have been motivated to do that.

...And lets not forget a tip of the hat to Ol' Sheriff Joe down in PHX;  a classic Drug Warrior.  If He'd just lose Marijuana from his Drug War Agenda he wouldn't have to have a Tent City Jail Annex Facility for overcrowding -and would have better focus on the METH and Bad Drugs -oh and crime too.

Drug laws are the biggest part of the nation's drug problem.

The purpose of the Drug War is to ruin lives of your political and cultural enemies.

...Folks, It would only take 2 or 3 lawsuits per state to get a handle on this Unconstitutional issue. They are testing their limits and in need of a nice smash on the snout...

The Colorado State Patrol has soiled their once proud reputation by intensifying profile searches of passing out of state travelers. Each state's DPS pulls over and tries to search travelers from other states, where they're at a disadvantage for pursuing  legal remedies. One state trooper commented -off record, that the out of staters just mail in the fines and don't come back for the jury trial proceedings.

N.J. SUPREME COURT LIMITS CAR SEARCHES
Associated Press

Police cannot ask to search a vehicle they have stopped unless there is
reasonable suspicion that criminal activity has occurred, the [N.J.]
state Supreme Court ruled. In a 5-0 decision issued Monday, the court
said motorists need protection because of "widespread abuses" by police
and the state's 1999 admission that troopers had practiced racial
profiling.

The Drug War causes police to have to "deceive and lie" to people.  A completely inappropriate application of Law Enforcement.

Sunday, August 17, 2003

Police at the Telluride festival had posted signs along the road saying, "Narcotics checkpoint, one mile ahead" and "Narcotics canine ahead." Officers wearing camouflage hid on a hill and watched for any people who turned around or appeared to toss drugs out of their windows after seeing the signs.
